Filing of Trademark Application

Vienna Codification
This stage applies when the trademark comprises figurative elements/logo. A Vienna Code is assigned if the trade mark comprises figurative elements/logo. The Vienna code is assigned based on the nature of the figurative element/logo. During this process, the trademark application status is shown as “Sent for Vienna Codification”.
Trademark Examination
After Vienna Codification, the trademark officer will check the application for its completeness, correctness and whether the mark is appropriate or not. If he thinks that everything is in order, he will approve the application and send it for publication in the trademark journal. Further, if he is of the view that the application is incomplete or the desired trademark is identical or similar to another mark, he may raise objection. In such a case, you will get 30 days to file the reply.
Trademark Published in Journal
If no objection is raised or the trademark registry is satisfied by your reply against the objection raised, the trademark will be published in the Trademark Journal. The trademark journal is published on a weekly basis. The trademark is published for a period of 90 days so as to give an opportunity to the public to raise opposition if they think that the mark should not be registered. If an opposition is raised the matter then goes into litigation which generally take quite a long time.
Trademark Registration
In cases where no opposition is raised the trademark gets registered and the certificate of registration is issued to the applicant.
